nitro - Content Usage Guidelines

If contact is required, please only contact using this website's contact form.

I will not respond to inquiries made via private/direct message on any social network.

You must provide as many details as possible about the use case in the message, including if the work is unreleased or in development. I will not respond to vague requests asking to email back for more details.

Music

Crediting

When crediting, please make sure to correctly spell and use accurate capitalization on song titles and the artist name.

  • If you are unsure of an alias being used for an artist name in one of my songs, using just “nitro” is allowed.

  • Exceptions are allowed for song titles that cannot be correctly displayed due to the use of special characters.

 

When linking to original sources, you may only link from these official sources:

Any source not on these pages should not be used as a source credit.

Exclusions

Note that these following songs are excluded from these guidelines, as they are owned not by me, but by the companies or organizations listed. Please follow any derivative works guidelines by the respective organizations if they exist, and do not contact them for personal use unless allowed by their guidelines.

Disclaimer

I reserve the right to change these guidelines at any time, or make exceptions for specific uses based on my own personal judgement.

I explicitly disallow the use of my work in content related to hate speech, discrimination, content intending to create offense, or other content that does not align with my morals, and I may request the removal of my work from the content if found.

For Rhythm Games
Non-commercial, Community-based

You may use my music with no need for permission, as long as the songs are clearly credited. Redistribution of the song file and modifications for length are only allowed within the purpose of the game, and must be in a compressed/lossy format.

Links to the original sources must be included. The links do not have to be visible in-game, and can be in the form of a credits/readme file or in a description alongside the download links.

In this case, “non-commercial community-based rhythm games” refers to games for which there is no or very little “official” content, and the majority of content for the game is community-generated. The game must not be monetized in any way, directly or indirectly. 

If you are seeking usage for community content, but for a game that has significant official content, rules for "Curated" non-commercial games apply, shown below.

Non-commercial, Curated

You must obtain my permission to use my music in your game. The terms of the agreement can be discussed, but generally, crediting requirements remain the same as non-commercial community-led games (see above). This also applies to community-based custom content for the game.

If your game is currently unreleased or in development, I will ideally require a playable build or gameplay video, or if not, references and a detailed description of the game. If you do not provide these and do not have a proven track record of released games, I may decline.

I reserve the right to refuse permission without giving a specific reason.

In this case, “non-commercial curated rhythm games” refers to games for which content is mainly “official”, created by a core group of creators, or sourced from the community but filtered through some kind of judging/quality check by an authority. The content can either be included in the game as official content, or featured as part of a core content set. The game may also feature community-based custom content features, for which these rules also apply. The game must not be monetized in any way, directly or indirectly.

Commercial 

A paid license contract is required for commercial use. Please contact me via email to discuss the terms of the agreement. I will not respond to requests from community members seeking to obtain permission separately from the game development team and its legal representatives. 

In this case, “commercial rhythm games” refers to games for which any aspect of the game is monetized. This includes but is not limited to games for which:

  • Custom content is community-led and not monetized, but initial access to the game is paid,

  • Initial access to the game is free, but paid content exists, or

  • Access to the game and all of its content is free, but is monetized via advertisements or payments/subscriptions for in-game benefits not directly tied to content..

 

For Other Use
Background Music, Streaming, Non-commercial Videos

You may use my music as background music (BGM) without permission as long as I am properly credited in the description or in the video, with at least one link to an original source. This includes use in monetized livestreams (e.g. via YouTube’s Partner Program, Twitch’s Partner Program, etc.), and in DJ sets/live mixes. 

This excludes use in monetized videos, which is considered commercial use and requires a paid license contract.

Sampling, Remixing (Non-commercial)

You may sample my music in your own track and remix it as long as I am properly credited in a description, with an original source linked.

If you intend to monetize your track, please contact me first to discuss an agreement.

Reuploading, Redistribution

Reuploads, especially with the intention of listening to the song, are strictly not allowed under any circumstance, on any platform, monetized or not.

The only exception to this will be for non-commercial community-led rhythm games, where the song file is being distributed for the explicit purpose of having rhythm gameplay synchronized with it. The download must be accompanied by a chart/map/level/譜面 file with meaningful gameplay (i.e. not as an excuse to simply redistribute the music).

AI datasets

My music is explicitly not allowed to be included in any AI dataset for any reason.

NFTs

My music is explicitly not allowed to be minted/tokenized as NFTs for any reason.

Other use

Please contact me for uses that are not covered in these terms.

Art

All of the art on my DeviantArt page is released under a Creative Commons Attribution 3.0 Unported license. Please refer to the license itself for the terms of use. Contacting me to let me know you have used my art is appreciated, but not required.

 

My art is not allowed to be included in any AI dataset, or minted/tokenized as NFTs.
